Section 22.69 of the Zoning Code Who Can Apply for a Change in ZoningOne or more of the property owners or lessees of property within the area proposed to be changed or effected. Requirements for SubmissionRezoning petitions must be submitted to the office of the City Clerk along with a $350 filing fee. A rezoning petition form can be obtained from the Planning Department. The petition must include a legal description of the area to be reviewed. NoticeThe Plan Commission requires seven (7) complete collated sets AND 7 reduced sets of all items listed below along with a copy in digital form. One of the seven sets submitted must be colored and rolled. If it is mounted on a board, we will need an extra set that is rolled. They must be full-size sets and must be submitted to the Department of Community Development by 4:00 pm on Tuesday of the week before a Plan Commission meeting in order to be placed on the agenda for that meeting. Rezoning ProcedureRezoning petitions are submitted by the City Clerk to the Planning Department. The Planning Department will review the material, consult with the applicant, and present the application for an amendment or district change to the Plan Commission. The Plan Commission will vote to recommend that the application be granted as requested or with modifications, or they may recommend the application be denied. The recommendations will then be sent to the Common Council. HearingThe Common Council will hold a public hearing after receiving the recommendations of the Plan Commission. Public notice of the proposed changes and the time and place of the hearing will be published and neighbors notified. Because City of Waukesha does not have the name and address of town residents on file, the town government will be notified if neighboring properties are in one of the surrounding townships. Any interested party or township resident can be notified by leaving a self addressed stamped envelope. The Common Council will consider the recommendations of the Plan Commission and vote on the proposed change. Final ActionIf the rezoning receives a favorable vote at the public hearing, a rezoning ordinance will be prepared and brought back to the next meeting. Normally the ordinance is presented at three consecutive meetings, after which the Common Council would vote on the ordinance. These three "readings" can be waived at the request of an Alderman. The proposed change becomes effective when the ordinance is adopted. A favorable vote of 3/4 of the Common Council is needed if 20% of the owners of land immediately adjacent within 100 feet or 20% of the owners of land directly opposite the street frontage within 100 feet sign a petition protesting the change.
