Impact FeesSection 4.10 of the Waukesha Municipal Code PurposeWhen underdeveloped land is developed it often creates the need for additional infrastructure such as roads, water, sewage, storm water facilities as well as parks and recreational facilities and other public facilities. The challenge faced by the City is to find an equitable way to fund this new infrastructure. The City can forego the new needed public services, impose additional taxes on current residents or impose impact fees on developers to pay for public facilities. Following an action by the state legislature adopting an Impact Fee Law, the City enacted an ordinance to impose impact fees on certain developers in an effort for new development to pay its fair share of municipal capital costs. The Park and Recreation Board may determine that a plat or certified survey map may require a future park or other recreational facilities and require the developer to reserve such an area that the City will purchase within a three year period for such purposes. The developer may also be required to dedicate such land to the City as part of an impact fee payment |
